Terms and Conditions | Personal Driver Cluj

Acest document este disponibil și în limba română. Versiunea română este cea care produce efecte juridice.
These terms apply to every booking made through soferpersonalcluj.ro, by phone or via WhatsApp. Please read them before booking: by sending a request, you confirm that you accept them.
1. Who provides the service
- Eco Start Electric Rent S.R.L., trading as “Șofer Personal Cluj”
- CUI: 46738163 · Trade Register no.: J2022005439124
- Registered office: Str. Mehedinți nr. 41, Cluj-Napoca, Cluj County, Romania
- Phone: +40 753 402 330 · Email: [email protected]
2. What we offer
We provide a professional driver for private journeys: transfers to and from Avram Iancu Cluj International Airport, rides in the city and its surroundings, long-distance journeys within Romania and abroad, transport from the maternity hospital, delivery of parcels and envelopes, and driving your own vehicle on request.
The service is provided with our vehicles (Standard, Medium, Premium and VAN categories) or, if you choose the “Driver with your own car” service, with the vehicle you provide.
3. How a booking is made
You can book through the form on the site, by phone or via WhatsApp. A request sent through the form is an enquiry, not a confirmed booking. The contract is formed when we confirm your booking, by phone or in writing, stating the time, the pick-up point and the agreed price.
For every service a written service contract is signed, in two original copies, one for each party, setting out the route, the date and time, the number of hours contracted, the price and the overtime hourly rate. These terms are supplemented by that contract; in the event of any discrepancy, the signed contract prevails.
To provide the service we need: your name, a phone number where you can be reached, the date and time you want, the pick-up address and the destination. If children are travelling, tell us their age and weight when booking so we can fit the right car seat.
4. Prices
The applicable rates are those published on the Prices page. In short:
- City rides (up to 18 km, in Cluj-Napoca and neighbouring localities) are charged by the hour: the first hour at the category's starting rate, then the hourly rate.
- Long-distance rides are charged per kilometre in tiers (first 50 km, then 50–500 km, then over 500 km).
- Round trips: the one-way price is multiplied by 1.30.
- Night rides (22:00–06:00): a 20% surcharge on top of the standard rate.
- Child car seats are included at no extra charge, on request.
The price shown by the calculator on the site is an estimate based on road distance. The final price is communicated and agreed when the booking is confirmed and may differ if there are additional stops, waiting time, route changes, or road, parking and restricted-area charges. Rates are quoted in euro; payment may be made in euro or in lei at the day's exchange rate.
5. Payment
We accept cash, card payment and bank transfer to account RO69BTRLRONCRT0CI1409101, held with Banca Transilvania Cluj. For business customers we issue a fiscal invoice.
When payment is due depends on the service:
- Transport in our vehicles: payment is made at the end of the ride or against the fiscal invoice we issue.
- Driver with your own car: the full value of the service must be paid at the start of the ride, before the vehicle is handed over.
If the ride runs longer than the number of hours originally contracted, the overtime hourly rate agreed at booking applies. It is charged for every hour or part of an hour beyond the contracted duration.
6. Cancellation, amounts paid and unforeseen situations
6.1. Amounts already paid
As a rule, amounts already paid are not refunded. The only exception is where the service cannot go ahead through our exclusive fault, for example a technical failure of our vehicle. In that case up to 50% of the amount paid is refunded.
6.2. If our vehicle breaks down
If the vehicle suffers a technical failure, damage or becomes unable to travel, including following an incident caused by our driver, we provide a replacement vehicle so the ride can continue, delivered to the agreed location, at no additional cost to you.
6.3. External factors
If travel becomes impossible because of factors outside our control, such as road incidents caused by other road users, extreme weather or road closures, we will look together for the best solution for both parties.
6.4. Cancellation by you
Please tell us as early as possible if you are cancelling the ride. The applicable cancellation terms are those set out in the contract signed for that service, read together with the rule in point 6.1.
6.5. Waiting time
For airport transfers we monitor the flight in real time. Waiting of up to 60 minutes after the actual landing time is included in the fare. For other rides, the included waiting time is 15 minutes from the agreed pick-up time. Beyond those windows the overtime hourly rate applies.
7. Your obligations
- Pay for the services contracted, including any additional hours calculated under point 5.
- Be at the agreed place and time, and tell us in good time about any change.
- Behave properly and keep the vehicle clean throughout the journey.
- Do not ask the driver to break traffic rules or any law in force.
- Follow safety rules: seat belt, the driver's instructions, use of the child car seat.
- Do not smoke and do not use prohibited substances in the vehicle.
- Do not carry dangerous or illegal goods, or goods that may damage the vehicle.
- Bear the cost of cleaning or repair if you culpably cause serious soiling or damage to the vehicle.
The driver may refuse or interrupt the ride if their safety or that of the passengers is at risk, if a passenger behaves aggressively, or if the requested transport would breach the law. In such a case, the ride is treated as performed and is charged.
8. Luggage and personal belongings
Luggage is carried within the space available in the vehicle category chosen. If you have bulky or numerous items, tell us when booking so we can select a suitable car.
We are not liable for the loss, damage or disappearance of goods, valuables, money or valuable items left in the vehicle by you or your passengers. Items left behind are kept for 30 days and returned on request; the cost of returning them, if a journey is involved, is borne by you.
9. The “Driver with your own car” service: special conditions
When we drive your vehicle, the following conditions apply, separate from those for rides made in our own cars.
9.1. What you declare and guarantee
- That you are the rightful owner or legal holder of the vehicle and that you unconditionally accept handing over the keys and the car to the driver we assign.
- That the vehicle is in good working order, has a valid periodic technical inspection, valid third-party insurance and, where applicable, comprehensive cover, a road toll vignette and all legal documents required for use on public roads.
- That you inform the driver, before departure, of any fault, warning light on the dashboard, anomaly or particular handling characteristic of the vehicle.
9.2. Auxiliary costs
Fuel, road tolls, parking and any other charges related to the route are borne solely by you.
9.3. Liability for the vehicle
By the nature of this service, you expressly and fully assume the risks of entrusting your vehicle to our driver and having it driven by them. We and the assigned driver are released from any material, civil, administrative or criminal liability for damage, harm, technical failures, wear or destruction caused to the vehicle during the service, whatever the cause, including in the event of a road accident, collision, mechanical or electrical failure, or incidents caused in traffic.
Any repair, damage or harm caused to your car or to third parties is covered in full by you, directly or through the insurance policies attached to the vehicle.
We are not liable for technical failures, engine, gearbox, braking or steering system failures, a flat tyre or any other unforeseen fault arising during the ride or afterwards.
9.4. Fines
Fines resulting from technical faults or omissions of the car, for example an expired technical inspection, missing third-party insurance, a missing road toll vignette or faulty lights, concern you alone. Fines relating to traffic rules directly attributable to the driver's manoeuvres are borne by the driver.
9.5. When the service cannot continue
In the event of a breakdown, accident, extreme weather or road closures caused by faults of your car that prevent the ride from continuing, we are not obliged to provide a replacement vehicle and we do not refund amounts already paid.
10. Liability
We provide the service with professional care and with vehicles insured as required by law. We are not liable for delays or non-performance caused by events beyond our control: unforeseen traffic jams, accidents on the route, extreme weather, road closures, strikes or other cases of force majeure. We recommend allowing a reasonable time margin when you have a flight or train to catch.
For the “Driver with your own car” service, the special liability regime in point 9 applies in addition, and you accept it by signing the corresponding contract.
Nothing in these terms limits our liability where the law does not permit it.
11. Complaints and dispute resolution
If you are unhappy with the service, write to [email protected] or call +40 753 402 330. We answer any complaint within 30 days at the latest.
If we do not reach a solution, you may turn to:
- the Romanian National Authority for Consumer Protection (ANPC): anpc.ro, including through the Alternative Dispute Resolution (SAL) procedure;
- the European Online Dispute Resolution platform (ODR): ec.europa.eu/consumers/odr;
- the courts having jurisdiction at our registered office, in Cluj-Napoca.
About the right of withdrawal: passenger transport services are, in principle, excluded from the rules on distance contracts under Art. 2(3)(k) of Romanian Government Emergency Ordinance no. 34/2014, which transposes Directive 2011/83/EU. The 14-day right of withdrawal therefore does not apply. Instead, our own cancellation terms in section 6 apply, which let you cancel free of charge within the periods stated there.
12. Intellectual property
The texts, images, logo and structure of this site belong to us or are used under licence. You may read them and share them by link, but you may not copy and republish them for commercial purposes without our written consent.
13. Personal data
How we process your data is described in our Privacy Policy, and the cookies used by the site in our Cookie Policy.
14. Applicable law and changes
These terms are governed by Romanian law. We may amend them; the version applicable to your booking is the one published on the site when your booking was confirmed. The date of the last update is shown at the top of the page.
